Welcome to 5e Maker ("Service", "we", "us"). These Terms govern your use of https://5emaker.com and our AI-powered tabletop RPG tools. By accessing or using the Service, you agree to be bound by these Terms.

1. Service Description
5e Maker is an independent, AI-powered toolkit for tabletop role-playing game content generation. We generate monster stat blocks, NPCs, encounters, character backstories, and character sheets compatible with the System Reference Document 5.1 (SRD 5.1) published by Wizards of the Coast LLC, used under the Creative Commons Attribution 4.0 International (CC-BY-4.0) license.
5e Maker is NOT affiliated with, endorsed by, sponsored by, or approved by Wizards of the Coast LLC. See our Disclaimer.
2. Eligibility
You must be at least 13 years old to use the Service. If between 13 and the age of majority in your jurisdiction, you may only use the Service with parental/guardian consent.
3. Account Registration
3.1 Free Tier
Requires no registration. You may use the Service up to the free-tier limits (3 monsters + 1 character/day, by IP) without providing personal info.
3.2 Pro and Lifetime Plans
Provide a valid email and pay via PayPal. You are responsible for credential confidentiality and all activity under your account.
4. Acceptable Use
You agree NOT to:
- Generate prohibited content: sexual content involving minors (zero tolerance, reported to NCMEC), content that incites violence/discrimination, depictions of real persons in sexual/violent/defamatory contexts, third-party IP infringement.
- Misuse the Service: circumvent rate limits or paywalls, scrape/mirror, reverse-engineer, use automated tools, resell or sublicense.
- Abuse infrastructure: DDoS, security probing without authorization.
- Violate third-party rights: generate Wizards of the Coast proprietary characters/settings not in SRD 5.1 (e.g., Beholder, Mind Flayer, Forgotten Realms).
Violations may result in immediate termination without refund.
5. Intellectual Property — Our Service
The Service (website, code, brand "5e Maker", logos, system prompts) is owned by [Your Company LLC]. Wizards of the Coast trademarks ("Dungeons & Dragons", "D&D", dragon ampersand) are property of WotC. We claim no affiliation.
6. Intellectual Property — Generated Content
6.1 Ownership
You retain all rights to your inputs and any modifications you make.
6.2 AI Copyright Limitation
Under US copyright law (Thaler v. Perlmutter, D.C. Cir. 2025) and US Copyright Office guidance (March 16, 2023):
- Content generated entirely by AI without meaningful human creative input is NOT eligible for copyright protection in the United States.
- Content with substantial human creative contribution may be copyrightable, but copyright extends only to the human-authored portions.
5e Maker makes no representation about copyright status of specific outputs. Consult an attorney if copyright protection is important to you.
6.3 License to Us
You grant 5e Maker a non-exclusive, perpetual, royalty-free, worldwide license to: process your input through our AI pipeline to generate output; display anonymized examples in marketing (only with your opt-in or after you publicly share). No training of AI models without explicit opt-in.
6.4 SRD 5.1 Attribution
Generated content may include elements derived from SRD 5.1, used under CC-BY-4.0: "5e Maker uses content from the System Reference Document 5.1 by Wizards of the Coast LLC, licensed under CC-BY-4.0."
6.5 Commercial Use
- Free tier: personal, non-commercial only.
- Pro / Lifetime: commercial purposes allowed (e.g., DriveThruRPG, DM's Guild), subject to CC-BY-4.0 attribution and AI copyright limitation in Section 6.2.
7. Pricing and Payments
Current pricing on our Pricing page. All payments processed by PayPal. By purchasing, you authorize automatic renewal (Pro Monthly/Annual) or one-time charge (Lifetime). See Refund Policy for cancellation, refunds, chargebacks, taxes.
8. Disclaimers and Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. We do not guarantee that AI-generated content is original, accurate, mechanically balanced, copyrightable, or suitable for any specific game session.
Regarding D&D 5e content: Generated stat blocks are AI-produced approximations. GMs should verify mechanical balance before using content in actual play. We are not liable for in-game outcomes (e.g., TPK from imbalanced encounters).
9. Limitation of Liability
To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages. Our total liability is limited to the amount you paid us in the 12 months preceding the claim.
10. Indemnification
You agree to indemnify 5e Maker from claims arising from your use of the Service, violation of these Terms, infringement of third-party rights, or commercial use of generated outputs.
11. Service Changes and Termination
We may modify, suspend, or discontinue the Service at any time. If discontinued entirely, active Pro/Lifetime subscribers receive 30 days notice and a prorated refund. We may suspend accounts for violations of Section 4 without refund.

13. Governing Law and Disputes
Governed by the laws of Wyoming, United States. Before formal claims, contact contact@5emaker.com for 30 days of informal resolution. US users: binding individual arbitration under AAA rules. EU/UK users retain local consumer protection rights.
14. Changes to These Terms
Material changes notified via Site banner for 30 days and email to Pro/Lifetime users. Continued use after changes constitutes acceptance.
